Restricted Chemical Substances
California 65 PROP65
California has recently tightened Proposition 65, which was passed before 1986, causing concern among suppliers in various regions. The regulation lists over 700 chemical substances as "known carcinogens" or "known to cause damage to the reproductive system," including common metals such as lead and cadmium; And it is stipulated that merchants must attach "clear and reasonable" warning labels to consumer goods that may release such substances.
According to Proposal No. 65, any person involved in the operation process, including retailers, importers, distributors, as well as overseas exporters, traders, and producers, must comply with relevant regulations. If individuals violate regulations, citizens or environmental groups can file lawsuits on behalf of the public, and the court can impose a maximum fine of $2500 for each problematic product sold to California consumers in the past year. If the prosecution wins, the lawyer representing the citizens in filing the lawsuit can collect investigation fees in addition to legal fees, often totaling up to $1 million or more.
Ceramic tableware is one of the targets of Proposal No. 65. The last major revision of Proposal No. 65 was in 1993. According to merchants specializing in tableware, previously only the surface of tableware that comes into contact with food was regulated, but now the relevant definitions have been revised and they must comply. In August 2005, the new product scope covered by the regulation was approved by the court, adding control over colored decorative parts (including pigments and decorations) on non food contact surfaces of glass and ceramic utensils.
For decorative glassware, materials used to decorate the outer "lip" area (i.e. the top 20 millimeters) can only contain a maximum of 200 ppm of lead or 800 ppm of cadmium. Below the lip area, the decoration on the outside of the appliance can only contain a maximum of 600ppm lead or 4800ppm cadmium. Those who do not exceed the standard do not need to attach the warning label specified in Proposal No. 65. In addition, if there is no decoration in the lip area and NIOSH 9100 wiping test is conducted on all decorative surfaces, showing a lead release of less than 1 microgram and a cadmium release of less than 8 microgram, there is no need to attach a warning label.
According to the regulations, based on the results of 24-hour lead acetate solution testing, the concentration of lead released from the food contact surface of flat ceramic tableware (such as plates) shall not exceed 0.226 parts per million (0.226 ppm), and the concentration of lead released from the food contact surface inside ceramic hollow tableware (such as tea and water cups) shall not exceed 0.100 ppm. In terms of ceramic tableware, if according to the test results of lead acetate solution, the concentration of lead released from the food contact surface of flat ceramic tableware does not exceed 0.226ppm, and the concentration of lead released from the food contact surface inside ceramic hollow tableware does not exceed 0.100ppm, and meets the standards applicable to glassware, there is no need to attach warning words about external decoration. According to ASTM C-927 test results, the release of lead and cadmium within the lip range of the product shall not exceed 0.050 micrograms per milliliter and 4.00 micrograms per milliliter, respectively.
According to Proposal No. 65, if ceramic tableware contains excessive substances, suppliers must add warning labels. For example, consumer products containing known carcinogenic chemicals must be accompanied by a warning message that reads' Warning: This product contains a chemical known to the State of California to cause cancer '. If the product contains chemicals known to damage the reproductive system, a warning must be added stating 'Warning: This product contains a chemical known to the State of California to cause defects or other reproductive harm'.
Remind relevant enterprises exporting to California, USA to conduct technical evaluations and preparations as soon as possible to ensure that decorated glass and ceramic utensils comply with the provisions of Proposition 65, in order to avoid unnecessary losses.
California Proposition 65: Readjust the lead content in consumer goods
Prop 65, also known as the 1986 Safe Drinking Water and Toxic Substances Act, is a bill passed by California residents through a vote in 1986. The bill requires California to publish a list of chemicals known to cause cancer, congenital defects, or reproductive toxicity. The California Proposition 65 List was first released in 1987 and now covers approximately 900 chemical substances.

California Proposition 65: Setting limits for BPA content in consumer products
Since May 11, 2015, bisphenol A (BPA, CAS number: 80-05-7) has been classified as a chemical known to cause reproductive toxicity in women. Since May 2016, law enforcement actions have been taken against companies that failed to warn consumers of exposure to BPA, and multiple cases have been reached regarding thermal paper and food contact products such as polycarbonate tableware. Later in the case, the requirement for BPA was renegotiated from "not exceeding 1000 ppm" to "BPA free", and the option to provide a warning for California Proposition 65 was not modified.

California Proposition 65: Readjustment of Phthalate Content in Consumer Products
The California government is aware that six phthalates can cause cancer, congenital malformations, and other reproductive harm, or have all of these toxicities simultaneously. These six phthalates are:
- Methyl butyl phthalate (BBP, CAS number 85-68-7)
- Dibutyl phthalate (DBP, CAS number 84-74-2)
- Diisooctyl phthalate (DEHP, CAS number 117-81-7)
Diisodecyl phthalate (DIDP, CAS numbers 68515-49-1 and 26761-40-0)
Diisononyl phthalate (DINP)
- Di-n-hexyl phthalate (DnHP, CAS number 84-75-3)
